Right of withdrawal
If the Customer is a "consumer" (i.e. a natural person acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out), the Customer has the right, pursuant to Directive 2011/83/EU on consumer rights and, for Italy, Articles 52 et seq. of Legislative Decree No. 206/2005, Consumer Code, to return the purchased goods without any customisation within 30 calendar days from the date of delivery of the order, by communicating the withdrawal no later than two weeks from the date of delivery of the order itself.
Returns are not provided for purchase contracts relating to goods made to measure or clearly customised, and in any other case provided for by Article 16 of Directive 2011/83/EU and, for Italy, Article 59 of the Consumer Code.
The right of withdrawal must be exercised by the Customer by sending a written communication to Gadget Lab Srl - Viale Antonio Pacinotti, 9 - 51100 Pistoia, Italy or by e-mail to the certified e-mail address: gadgetlab@pec.it, containing:
- the explicit statement of the wish to exercise the right of withdrawal;
- the indication of the order number relating to the Sales Contract from which the Customer intends to withdraw.
In the event that the Customer exercises the right of withdrawal:
- the Customer must communicate the withdrawal within two weeks from the date of delivery of the goods;
- the Customer must return the goods within 30 calendar days from the date of delivery of the order;
- the goods must be shipped to Gadget Lab Srl - Viale Antonio Pacinotti, 9 - 51100 Pistoia, Italy;
- all direct costs connected with the return of the Products are entirely borne by the Customer, unless otherwise agreed in writing with Gadget Lab Srl or otherwise provided for by the applicable law.
Gadget Lab Srl undertakes to reimburse the Customer for all payments received, in accordance with the applicable law, without undue delay and in any event within 14 days from the date on which it was informed of the Customer’s decision to withdraw from the contract.
Gadget Lab Srl may withhold the reimbursement until it has received the goods or until the Customer has provided proof of having shipped back the goods, whichever is earlier.
The reimbursement will be made using the same means of payment used by the Customer for the initial transaction, unless otherwise expressly agreed between the parties and provided that the Customer does not incur any costs as a result of the reimbursement. Gadget Lab Srl may request from the Customer the bank details necessary to make the reimbursement, where required.
The Products must be returned intact, complete with any accessories and, where possible, in their original packaging. The Customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
If the returned product is deteriorated, damaged or used in a way other than what is necessary to establish its nature, characteristics and functioning, Gadget Lab Srl may reduce the reimbursement amount in proportion to the diminished value of the product.
